     AN ACT Relating to aquaculture facilities; and adding a new section to chapter 15.85 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 15.85 RCW to read as follows:

     (1) Before deciding on an aquaculture facility site an environmental impact statement shall be required.  The statement must show the economic and aesthetic benefits of the proposed project for review.

     (2) In addition to the economic and aesthetic benefit analysis in subsection (1) of this section, the statement must show whether any adverse effects of the proposed project have an effect on the adjacent property values, including whether the county where the proposed project is located will suffer any loss of tax revenue.

     (3) If a determination shows:

     (a) The proposed project will show a benefit;

     (b) That the proposed project will cause the county or local government a loss of tax revenue;

then that economic and aesthetic benefit shall be returned to the county or local governments to compensate it for those losses.
