     AN ACT Relating to timber sales from state lands; and adding a new section to chapter 79.01 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 79.01 RCW to read as follows:

     (1) Restricted timber from timber sales on lands owned or managed by the department of natural resources within designated timbersheds shall receive primary processing at a processing facility within the counties included in the timbershed where the timber originated.

     Restricted timber originating on lands owned or managed by the department of natural resources not included in a designated timbershed may be processed at any domestic processing facility.

     This requirement for primary processing within the timbershed of origin may be waived on a case-by-case basis by the department of natural resources for specific restricted timber sales.  Such waiver may be granted only after the timber has been sold and after the purchaser demonstrates that adequate processing capacity does not exist in the timbershed for the timber that was the subject of the specific sale.  If a timber sale has been offered and does not receive any bids, the sale may be reoffered without the timbershed-of-origin processing requirement.

     The primary processing requirement does not apply to timber that is not of sawlog quality and is destined for facilities for processing into chips, pulp, or pulp products, nor to timber of sawlog quality that is destined for a facility to be processed into poles, posts, or pilings.

     (2) Designated timbersheds in Washington are:

     (a) The Olympic Peninsula, including all lands in Clallam, Grays Harbor, Jefferson, Mason, and Thurston counties.

     (b) Northwest Washington, including all lands in Skagit, Snohomish, and Skamania counties.

     (c) Southwest Washington, including all lands in Clark, Cowlitz, Klickitat, Lewis, Pacific, and Skamania Counties.

     (3) For the purposes of this section:

     (a) "Restricted timber sale" means a timber sale offered by the department of natural resources that has been designated as "export restricted" under chapter 240-15 WAC implementing P.L. 101-382, the forest resources conservation and shortage relief act of 1990.

     (b) "Primary processing" means the processing of timber of sawlog quality into lumber, veneer, or plywood by a sawmill, veneer plant, or plywood mill.

     (c) "Restricted timber" includes all material of sawlog quality that is the subject of a restricted timber sale, except western red cedar and hardwoods.
