     AN ACT Relating to higher education tuition and fee waivers, reduced fees, and residency exemptions; amending RCW 28B.15.502; adding new sections to chapter 28B.15 RCW; and repealing RCW 28B.15.522, 28B.15.535, 28B.15.540, 28B.15.558, 28B.15.543, 28B.15.545, 28B.15.546, 28B.15.547, 28B.80.245, 28B.80.246, 28B.15.225, 28B.15.524, 28B.15.526, 28B.15.527, 28B.15.555, 28B.15.556, 28B.15.725, 28B.15.730, 28B.15.732, 28B.15.734, 28B.15.736, 28B.15.750, 28B.15.752, 28B.15.754, 28B.15.756, 28B.15.758, 28B.70.050, 28B.15.014, 28B.15.380, 28B.15.520, 28B.15.620, 28B.35.361, 28B.40.361, 28B.15.100, 28B.15.450, 28B.15.455, 28B.15.460, 28B.15.465, 28B.15.470, 28B.15.475, 28B.15.480, 28B.15.615, and 28B.15.740.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.      Each state university, regional university, state college, and the community college system shall include a special report on tuition and fee waivers, reduced fee programs, and residency exemptions in its biennial budget request.  The report shall include specific data requested by, and in a format designed by, the office of financial management in consultation with the higher education coordinating board.  These special reports shall be aggregated and included in the governor's biennial budget document as part of an overview of higher education.

 

     NEW SECTION.  Sec. 2.      Prior to enactment, any new waiver, reduced fee, or residency exemption program considered by the legislature shall be evaluated on a set of common criteria.  In cooperation with the house of representatives and senate higher education and fiscal committees, the higher education coordinating board shall develop and recommend evaluation criteria for each proposed program.  The criteria shall include consideration of a financial needs test.

 

     NEW SECTION.  Sec. 3.      Any new waiver, reduced fee, or residency exemption program adopted by the legislature shall include a provision for evaluation and reauthorization after an initial term of implementation.  The reauthorization provision shall require the program to expire on a specific date unless legislation is enacted to reauthorize the program.

 

     NEW SECTION.  Sec. 4.      The percentage of aggregate tuition and fee revenue that a state university, regional university, state college, or the community college system may waive in any biennium for existing or new programs is limited as follows:  Each research university shall not waive more than twenty-four percent; each regional university and the state college shall not waive more than twelve percent; and the community college system shall not waive more than thirty-seven percent.

 

     NEW SECTION.  Sec. 5.      No new space available waiver programs shall be enacted until existing space available waiver programs have been evaluated by the higher education coordinating board, in cooperation with institutions of higher education.  The evaluation process shall include consideration of overall access, demand, and effectiveness in achieving program goals.

 

     NEW SECTION.  Sec. 6.      For any space available waiver program

that directs an institution to charge an administrative fee of not less than five dollars, each institution of higher education granting a waiver under the program shall charge an administrative fee that will fully cover the institution's cost of administering a participating student's enrollment.  The administrative fee shall be the same for all space available waivers granted by the institution, and shall be charged to all students receiving a space available waiver by the institution.

 

     Sec. 7.  RCW 28B.15.502 and 1985 c 390 s 25 are each amended to read as follows:

     Tuition fees and services and activities fees at each community college other than at summer quarters shall be as follows:

     (1) For full time resident students, the total tuition fees shall be twenty-three percent of the per student educational costs at the community colleges computed as provided in RCW 28B.15.067 and 28B.15.070:  PROVIDED, That the building fees for each academic year shall be one hundred and twenty-seven dollars and fifty cents.

     (2) For full time nonresident students, the total tuition fees shall be one hundred percent of the per student educational costs at the community colleges computed as provided in RCW 28B.15.067 and 28B.15.070:  PROVIDED, That the building fees for each academic year shall be four hundred and three dollars and fifty cents.

     (3) The boards of trustees of each of the state community colleges shall charge and collect equally from each of the students registering at the particular institution and included in subsections (1) and (2) hereof a services and activities fee which for each year of the 1981-83 biennium shall not exceed sixty-four dollars and fifty cents.  In subsequent biennia the board of trustees may increase the existing fee, consistent with budgeting procedures set forth in RCW 28B.15.045, by a percentage not to exceed the percentage increase in tuition fees authorized in subsection (1) above:  PROVIDED, That such percentage increase shall not apply to that portion of the services and activities fee previously committed to the repayment of bonded debt.  The services and activities fee committee provided for in RCW 28B.15.045 may initiate a request to the governing board for a fee increase.

     (4) Until June 30, 1996, tuition and services and activities fees consistent with the above schedule will be fixed by the state board for community colleges for summer school students.

     The board of trustees shall charge such fees for ungraded courses, noncredit courses, community services courses, and self-supporting short courses as it, in its discretion, may determine, not inconsistent with the rules and regulations of the state board for community college education.
