     AN ACT Relating to recycling vending machine product containers; and adding a new section to chapter 70.95 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 70.95 RCW to read as follows:

     (1) Receptacles for recycling glass, aluminum, steel, or tin-coated steel containers dispensed by a vending machine shall be located in the vicinity of the vending machine.  The owner or operator of the vending machine shall either provide and service the receptacles or may enter into an agreement to have the receptacles provided and serviced by another entity, including but not limited to, persons working in a building in which a vending machine is located and nonprofit charitable organizations.

     (2) For purposes of this section, "vending machine" means any coin-operated machine that:

     (a) Sells or provides food, tobacco, sundries, or other retail merchandise in a container that is composed of more than ten percent by weight of glass, aluminum, steel, or tin-coated steel; and

     (b) Is located on a passenger ferry or in a rest area owned, operated, or maintained by the department of transportation.
