     AN ACT Relating to the containment of waste materials; and adding a new section to chapter 70.93 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 70.93 RCW to read as follows:

     (1) By January 1, 1993, each county or city with a transfer station or landfill in its jurisdiction shall adopt an ordinance to reduce litter from vehicles.  The ordinance shall require the operator of any vehicle transporting solid waste to a transfer station or landfill to cover the vehicle's waste in a manner that will prevent spillage.  A county or city adopting an ordinance under this section may require the owner or operator of a landfill or transfer station to offer covers for sale.  A person buying a cover upon entry into a transfer station or landfill shall not be required to pay, at the time of purchase, the fee under subsection (2) of this section.  The ordinance may provide exemptions for vehicle operators transporting waste that is unlikely to spill from a vehicle moving at normal highway speeds.

     (2) At a minimum, the ordinance shall require the following fees, in addition to any other landfill charges, for any person arriving at a landfill or transfer station without a cover on the vehicle's waste:

     (a) Three dollars for loads of 0.1 to 3 cubic yards;

     (b) Five dollars for loads of 3.1 to 10 cubic yards;

     (c) Ten dollars for loads over 10 cubic yards.

     (3) The fee collected under subsection (2) of this section shall be deposited with the city or county in which the landfill or transfer station is located.
