     AN ACT Relating to private property owners' rights protection; and adding a new section to chapter 43.10 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 43.10 RCW to read as follows:

     (1) There is created within the attorney general's office a private property owners' rights protection division.

     (2) The division is concerned with issues arising from a city or county considering or taking an action which may impact the value or use of any private property, including, but not limited to, adoption or amendment of comprehensive plans or building codes, zoning actions, designations of open space or wetlands, and environmental determinations.

     (3) The duties of the division, with respect to issues under subsection (2) of this section, include:

     (a) Maintaining a "hotline" phone number for private property owners to call the division for information and to place complaints;

     (b) Receiving and investigating complaints from private property owners;

     (c) Mediating disputes; and

     (d) Instituting and prosecuting all actions and proceedings which may be necessary to protect private property owners' rights.
