Read first time 01/27/92.  Referred to Committee on Energy & Utilities.Requiring that the state request a NEPA EIS if actions pursuant to federal legislation are likely to result in radioactive waste entering the state at other than an approved port of entry.


     AN ACT Relating to entry of radioactive waste into the state; and amending RCW 46.48.200.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     Sec. 1.  RCW 46.48.200 and 1987 c 86 s 1 are each amended to read as follows:

     (1) Any additional ports of entry for highway transportation of radioactive waste materials other than those designated by WAC 446-50-040 as filed on December 11, 1979, must be authorized by the state legislature.  This section shall expire when both the Washington state legislature and at least one other eligible state enact an interstate agreement on radioactive materials transportation management.

     (2) If actions pursuant to federal legislation are likely to result in radioactive waste entering the state at other than the ports of entry specified in subsection (1) of this section, the state shall intervene in the actions and request that an environmental impact statement be prepared pursuant to the national environmental policy act.

     (3) Inspections identical to those performed at current ports of entry shall be performed at any subsequently designated ports of entry.  At any new port of entry a public safety tariff is imposed and shall be collected from each highway transporter of radioactive waste.  The tariff will be in an amount sufficient to fully pay the cost of the inspections.
