     AN ACT Relating to school districts; and adding a new section to chapter 28A.315 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 28A.315 RCW to read as follows:

     (1) No school district in the state may enroll more than thirty thousand full-time equivalent students.

     (2) All school districts with enrollments of thirty thousand or more full-time equivalent students on the effective date of this section shall initiate a process to divide the district into two or more separate school districts.  The process shall include the formation of an advisory committee composed of district personnel, parents, and community members to be appointed by the school district's board of directors.  Members on the advisory committee shall reflect the cultural diversity of the school district's student population.  The advisory committee shall make recommendations to the school district's board of directors on the following matters:  (a) Boundaries of the new school districts; (b) governance, organizational, and administrative matters pertaining to the formation of a new school district or districts; (c) equitable division of capital and financial assets between the new districts; (d) adjustments in bonded indebtedness; and (e) a plan for making an orderly transition from one to two or more school districts.  Recommendations of the advisory committee shall be submitted to the district's board of directors by July 1, 1993, and shall be acted upon by the district's board of directors in time to effectuate the division of the school district, and the creation of one or more new school districts, before September 1, 1994.

     (3) Any district that projects that its full-time equivalent student enrollment will exceed thirty thousand shall initiate the process provided in subsection (2) of this section in such a manner that the division of the district occurs before the district's enrollment exceeds thirty thousand full-time equivalent students.

     (4) The provisions of RCW 28A.315.010 through 28A.315.270 pertaining to the initiation and formation of new school districts and division of assets shall not be applicable.
