     AN ACT Relating to designation of historic places; amending RCW 27.34.230; and adding a new section to chapter 27.34 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.  A new section is added to chapter 27.34 RCW to read as follows:

     In all designations as historic places, the designating agency or department officials of the state, county, city, or its authorized agents must first obtain the written consent of the property owner.  The owners of places previously designated must give their written consent to continue designation by August 1, 1992, or the designation is void.  When seeking consent of a property owner, the owner must be fully informed of the consequences of accepting designation.  Upon thirty days written notice, a property may be withdrawn from designation by the property owner.  If the property received financial benefit from the government, reimbursement must be paid prior to the withdrawal of designation as a historic place.

 

     Sec. 2.  RCW 27.34.230 and 1986 c 266 s 12 are each amended to read as follows:

     The director or the director's designee shall:

     (1) Submit the budget requests for the office to the heritage council for review and comment;

     (2) Receive, administer, and disburse such gifts, grants, and endowments from private sources as may be made in trust or otherwise for the purposes of RCW 27.34.200 through ((27.34.290)) 27.34.280 or the federal act; ((and))

     (3) Develop and implement a cultural resource management plan; and

     (4) Enforce the provisions of section 1 of this act.
