     AN ACT Relating to solid fuel burning devices; creating new sections; making an appropriation; and providing an expiration date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

     NEW SECTION.  Sec. 1.      The legislature finds that solid fuel burning devices contribute up to twenty percent of the state's air pollution problems.  The legislature recognizes advancements made by the industry to produce more efficient, cleaner burning, and less polluting devices.  However, regulatory agencies base their administrative and enforcement policies on testing and monitoring standards that do not recognize current technology.

 

     NEW SECTION.  Sec. 2.      The task force on the testing and certification of solid fuel burning devices is created to:

     (1) Review current federal and state testing and certification requirements and procedures;

     (2) Recommend alternatives to current federal and state testing and certification requirements and procedures;

     (3) Conduct a pilot study to develop testing and certification procedures; and

     (4) Recommend new emission standards for devices sold in the state of Washington based on its findings.

 

     NEW SECTION.  Sec. 3.      The task force shall be appointed by the speaker of the house of representatives and the president of the senate and shall consist of:

     (1) Two members from the house of representatives committee on environmental affairs;

     (2) Two members from the senate committee on environment and natural resources;

     (3) Two members from the house of representatives committee on energy and utilities;

     (4) Two members from the senate committee on energy and utilitie;

     (5) One member representing solid fuel burning device manufacturers recommended by the chair of the house committee on environmental affairs and one member by the chair of the senate committee on environment and natural resources; and

     (6) One member representing the environmental community recommended by the chair of the house environmental affairs committee and one member by the chair of the senate committee on environment and natural resources.

 

     NEW SECTION.  Sec. 4.      In developing recommendations, the task force shall consult with representatives from the federal environmental protection agency, department of ecology, local air authorities, solid fuel burning device dealers and manufacturers, public and investor-owned utilities, citizen organizations, environmental organizations, and public health organizations.

 

     NEW SECTION.  Sec. 5.      There is appropriated for the biennium ending June 30, 1993, to the department of ecology from the wood stove education and enforcement account, RCW 70.94.483, .......... dollars for the purposes of this act.

 

     NEW SECTION.  Sec. 6.      By November 1, 1993, the task force shall report to the appropriate standing committees of the legislature.

 

     NEW SECTION.  Sec. 7.      This act shall expire July 1, 1994.
