Making it a crime to lure a minor or developmentally disabled person into a vehicle or structure.


          AN ACT Relating to crimes involving minors; adding a new section to chapter 9A.40 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 9A.40 RCW to read as follows:

          (1) A person who lures a minor or developmentally disabled person, as defined in RCW 71A.10.020, by aid of deception, promises, offers of gifts or other enticement, or by voice authority into a vehicle or structure without the knowledge or consent of the minor's parent or guardian is guilty of a class C felony punishable under chapter 9A.20 RCW.

          (2) In a prosecution under this section, it is a defense, which the defendant must prove by a preponderance of the evidence, that at the time of the offense the defendant acted without criminal intent and with intent to protect the health or safety of the minor or developmentally disabled person.
