AN ACT Relating to the privacy of information collected for emergency communications networks; adding a new section to chapter 38.52 RCW; and adding a new section to chapter 42.17 RCW.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:
NEW SECTION. Sec. 1. A new section is added to chapter 38.52 RCW to read as follows:
(1) Information collected, organized, acquired, or held by a county for emergency response purposes under RCW 38.52.500 through 38.52.550, or collected, organized, or held for similar purposes under other authority, is not public information and is exempt from the disclosure requirements of chapter 42.17 RCW. Such information is exempt under this section whether or not the information is exempt from chapter 42.17 RCW in other forms or at other locations before or after its collection or organization for use under this chapter.
(2) Information covered by this section includes, but is not limited to:
(a) Any data base of street names and address ranges within their associated communities defining emergency service zones for emergency response purposes;
(b) Any other data base used to create, store, or update information used to provide selective routing or automatic location identification functions for an emergency response program;
(c) Any other information regarding the address, location, size, value, or description of property, or regarding personal identification, including but not limited to names or phone numbers.
(3) This section affects information only after, and only to the extent that, it is collected, organized, acquired, or held for emergency response purposes under RCW 38.52.500 through 38.52.550 or for similar purposes under other authority. Information that is originally collected, organized, acquired, or held for other purposes, including but not limited to records of the county auditor and the county assessor, is not subject to this section in its original form, regardless of whether copies or other replications of the information are subsequently used as constituent parts of information that is subject to this section.
NEW SECTION. Sec. 2. A new section is added to chapter 42.17 RCW to read as follows:
Information identified as exempt in section 1 of this act is exempt from disclosure under this chapter.
