Establishing mandatory fines for persons convicted of drunk driving while transporting minors.


          AN ACT Relating to penalties for driving under the influence of liquor or drugs; adding a new section to chapter 46.61 RCW; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 46.61 RCW to read as follows:

          (1) A person who violates RCW 46.61.502 or 46.61.504 while transporting a passenger under the age of eighteen years, is subject to the following penalties in addition to those provided for in RCW 46.61.515 or other law:

          (a) Upon a first conviction under the circumstances described in this subsection, an additional mandatory minimum fine of two hundred fifty dollars and a mandatory one day of community service;

          (b) Upon a second or subsequent conviction within five years under the circumstances described in this subsection, an additional mandatory minimum fine of one thousand dollars and a mandatory ten days of community service.

          (2) Unless the court finds the convicted person to be indigent, a mandatory minimum fine required under this section may not be suspended or deferred.  Unless the court finds it would be a substantial risk to the convicted person's physical or mental well-being, a mandatory minimum sentence of community service required under this section may not be suspended or deferred.
