Requiring that criminal penalties set by cities and counties be the same as those set in state law.


          AN ACT Relating to uniform criminal penalties; adding a new section to chapter 35.21 RCW; adding a new section to chapter 36.01 RCW; providing an effective date; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 35.21 RCW to read as follows:

          Except as limited by the maximum penalty authorized by law, no city, code city, or town, may establish a penalty for an act that constitutes a crime under state law that is different from the penalty prescribed for that crime by state statute.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 36.01 RCW to read as follows:

          Except as limited by the maximum penalty authorized by law, no county may establish a penalty for an act that constitutes a crime under state law that is different from the penalty prescribed for that crime by state statute.

 

          NEW SECTION.  Sec. 3.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect July 1, 1993.
