                    SUBSTITUTE HOUSE BILL 1674

Requiring institutions of higher education, private vocational schools, and diploma and degree-granting institutions to disclose financial instability and changes in accreditation status.



    AN ACT Relating to disclosures by institutions of higher education; adding a new section to chapter 28B.10 RCW; adding a new section to chapter 28C.10 RCW; adding a new section to chapter 28B.85 RCW; and adding a new section to chapter 18.16 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 28B.10 RCW to read as follows:

    (1) Each institution of higher education as defined in RCW 28B.10.016, and each higher education institution as defined in RCW 28B.07.020, that is in danger of losing institutional or program accreditation because the institution has failed either to correct deficiencies noted that require immediate corrective action or to meet probationary standards imposed by its accrediting agency, shall, within ten working days of notification of such failures by the accrediting agency:   

    (a) Provide individual written notice of potential change in its accreditation status to all effected full and part-time students indicating:  (i) The cause for and nature of the change in accreditation status; (ii) the potential effect of such change on the students' education and training program, if any; and (iii) options available to students;

    (b) Provide written notice of potential change in its accreditation status to any inquiring or potential student; and

    (c) Before enrolling any new student, obtain a signed statement from the potential student acknowledging receipt of such notification.

    (2) The governing board of each institution shall adopt rules to implement this section.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 28C.10 RCW to read as follows:

    (1) Each private vocational school, as defined in RCW 28C.10.020, that is in danger of losing either its state license to operate or its institutional or program accreditation because the institution has failed either to correct deficiencies noted that required immediate corrective action or to meet probationary standards imposed by its accrediting or licensing agency, shall, within ten working days of notification of such failures by the licensing agency or the accrediting agency:

    (a) Provide individual written notice of potential change in its licensing or accreditation status to all effected full and part-time students indicating:  (i) The cause for and nature of the action taken by the licensing or accrediting agency; (ii) the potential effect of such adverse action on the students' education or training program, if any; and (iii) options available to students;

    (b) Provide written notice of potential change in its licensing or accreditation status to any inquiring or potential student; and

    (c) Before enrolling any new student, obtain a signed statement from the potential student acknowledging receipt of such notification.

    (2) The work force training and education coordinating board shall adopt rules to implement this section.

 

    NEW SECTION.  Sec. 3.  A new section is added to chapter 28B.85 RCW to read as follows:

    (1) Each degree-granting institution, as defined in RCW 28B.85.010, that is in danger of losing either its authorization to operate or to offer or grant degrees or its institutional or program accreditation because the institution has failed either to correct deficiencies noted that require immediate corrective action or to meet probationary standards imposed by its accrediting or authorizing agency, shall, within ten working days of notification of such failures by the authorizing agency or its accrediting agency:

    (a) Provide individual written notice of potential change in either its authority to operate or to offer or grant degrees or in its accreditation status to all effected full and part-time students indicating:  (i) The cause for and nature of the action taken by the authorizing or accrediting agency; (ii) the potential effect of such adverse action on the students' education or training program, if any; and (iii) options available to students;

    (b) Provide written notice of potential change in either its authority to operate or to offer or grant degrees or in its accreditation status to any inquiring or potential student; and

    (c) Before enrolling any new student, obtain a signed statement from the potential student acknowledging receipt of such notification.

    (2) The higher education coordinating board shall adopt rules to implement this section.

 

    NEW SECTION.  Sec. 4.  A new section is added to chapter 18.16 RCW to read as follows:

    (1) Each school, as defined in RCW 18.16.020, that is in danger of losing either its license to operate or its institutional or program accreditation because the institution has failed either to correct deficiencies noted that require immediate corrective action or to meet probationary standards imposed by its accrediting or licensing agency, shall, within ten working days of notification of such failures by the licensing agency or the accrediting agency:

    (a) Provide individual written notice of potential change in its accreditation or licensing status to all effected full and part-time students indicating:  (i) The cause for and nature of the adverse action taken by the licensing or accrediting agency; (ii) the potential effect of such adverse action on the students' education or training program, if any; and (iii) options available to students;

    (b) Provide written notice of potential change in its accreditation or licensing status to any inquiring or potential student; and

    (c) Before enrolling any new student, obtain a signed statement from the potential student acknowledging receipt of such notification.

    (2) The department of licensing shall adopt rules to implement this section.
