Requiring a seller of real estate to indicate whether or not the property is free from any claim of adverse possession.


          AN ACT Relating to adverse possession of real property; and adding a new section to chapter 64.04 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 64.04 RCW to read as follows:

          No agreement for the purchase and sale of real estate is enforceable by the seller unless the agreement contains, in typeface no smaller than other text provisions of the agreement, a statement in substantially the following form:

 

          "Seller (does) (does not) warrant that the property is free from any claim of adverse possession.  Purchaser is advised that if seller does not so warrant, purchaser may want to seek legal advice and/or a survey to determine the physical boundaries of the property."
