Requiring negotiation to mitigate probable adverse impacts of hazardous waste incinerators.


          AN ACT Relating to payment of fees for hazardous waste incineration facilities; and adding a new section to chapter 70.105 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.105 RCW to read as follows:

          The applicant for a permit for a hazardous waste incinerator shall negotiate with the legislative authority of any county which may be affected by the operation of the incinerator to mitigate all probable significant adverse impacts, including  economic impacts, on the county due to the facility's location and operation.  The mitigation may be in the form of fees paid to the county or other measures agreed to by the parties.  The negotiation shall be conducted pursuant to procedures established by the department under RCW 70.105.260 and any agreement reached shall be included as a condition of a permit issued by the department.
