Requiring additional financial responsibility for hazardous waste disposal facilities that incinerate hazardous wastes or substances.


          AN ACT Relating to hazardous waste disposal facilities; and adding a new section to chapter 70.105 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 70.105 RCW to read as follows:

          (1) In addition to other financial responsibility requirements, the department shall require a hazardous waste disposal facility with a permitted handling capacity to incinerate five thousand or more tons of hazardous wastes or hazardous substances to maintain financial responsibility in the amount of at least twenty-five million dollars to compensate for personal injury or damages to property that may result from discharges or emissions from the facility.

          (2) If a facility fails to maintain financial responsibility required by this section, the department shall immediately suspend the facility's permit to operate until the required financial responsibility is established to the satisfaction of the department.

          (3) Proof of financial responsibility required under this section may be given by filing:

          (a) A certificate of insurance;

          (b) A bond; or

          (c) A certificate of deposit of money or securities.

          (4) The department may adopt rules to implement this section.
