Requiring a permit to have biomedical waste.


          AN ACT Relating to biomedical waste transportation; and adding a new section to chapter 81.80 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  A new section is added to chapter 81.80 RCW to read as follows:

          (1) No person or business may haul biomedical waste for compensation on the public highways of this state without first having obtained a permit from the commission.  Such permit shall be granted upon:

          (a) A finding that the person is fit, willing, and able to provide transportation of biomedical waste;

          (b) A finding that a grant of such a permit is in the public interest;

          (c) A finding that such person has an operating plan, training plan, and packaging and containment program appropriate for biomedical waste;

          (d) A finding that such person will transport biomedical waste for treatment, storage, or disposal only to a facility that meets all local, state, and environmental regulations as determined by the appropriate local, state, and federal agencies; and

          (e) Payment of the appropriate filing fees authorized by this chapter for other applications of operating authority.

          (2) Every person who engages for compensation to perform a combination of services, a substantial portion of which includes transportation of biomedical waste, shall not engage in the same without first having obtained a permit to do so under this section.  An example of such a combination of services shall include, but not be limited to, sterilizing biomedical waste to render it noninfectious.  Every person engaging in such a combination of services shall advise the commission of what portion of the consideration is intended to cover the transportation service.  The rates or charges for the transportation services included in such combination of services shall be subject to control and regulation by the commission in the same manner as the rates of contract carriers.

          (3) As used in this section, "biomedical waste" has the same meaning as in RCW 70.95K.010.

          (4) The commission may adopt rules to implement this section.
