Requiring food and beverage service establishments to provide sick leave to their employees.


          AN ACT Relating to food and beverage service workers; adding a new section to chapter 69.06 RCW; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  The legislature finds that food and beverage service workers rarely have a sick leave benefit through their employers and in order to support themselves and their families often feel compelled to go to work when sick.  The legislature declares that this situation creates a danger to public health and therefore requires that food and beverage service establishments provide a minimum sick leave benefit to food and beverage service workers.

 

          NEW SECTION.  Sec. 2.  A new section is added to chapter 69.06 RCW to read as follows:

          Every establishment having in its employ any employees who are required by RCW 69.06.010 to have on file a food and beverage service worker's permit shall provide to every such employee a sick leave benefit.  Such sick leave shall accumulate at a minimum rate of one hour of sick leave for each twenty-two hours worked, except that the establishment is not required to credit more than eight hours of sick leave to the employee in any one month.  The establishment may not limit the total amount of sick leave accumulated by an employee.  Sick leave used shall be compensated at least at the rate of the employee's regular wage.  The employee shall have no right to compensation for unused sick leave unless such compensation is agreed to by contract.
