Modifying deposits to the housing trust fund.


          AN ACT Relating to the housing trust fund; amending RCW 43.185.050 and 59.18.270; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

        Sec. 1.  RCW 43.185.050 and 1991 c 356 s 4 are each amended to read as follows:

          (1) The department shall use moneys from the housing trust fund and other legislative appropriations to finance in whole or in part any loans or grant projects that will provide housing for persons and families with special housing needs and with incomes at or below fifty percent of the median family income for the county or standard metropolitan statistical area where the project is located.  At least thirty percent of these moneys used in any given funding cycle shall be for the benefit of projects located in rural areas of the state as defined by the department of community development.  If the department determines that it has not received an adequate number of suitable applications for rural projects during any given funding cycle, the department may allocate unused moneys for projects in nonrural areas of the state.

          (2) Activities eligible for assistance from the housing trust fund and other legislative appropriations include, but are not limited to:

          (a) New construction, rehabilitation, or acquisition of low and very low-income housing units;

          (b) Rent subsidies;

          (c) Matching funds for social services directly related to providing housing for special-need tenants in assisted projects;

          (d) Technical assistance, design and finance services and consultation, and administrative costs for eligible nonprofit community or neighborhood-based organizations;

          (e) Administrative costs for housing assistance groups or organizations when such grant or loan will substantially increase the recipient's access to housing funds other than those available under this chapter;

          (f) Shelters and related services for the homeless;

          (g) Mortgage subsidies, including temporary rental and mortgage payment subsidies to prevent homelessness;

          (h) Mortgage insurance guarantee or payments for eligible projects;

          (i) Down payment or closing cost assistance for eligible first-time home buyers;

          (j) Acquisition of housing units for the purpose of preservation as low-income or very low-income housing; and

          (k) Projects making housing more accessible to families with members who have disabilities.

          (3) Legislative appropriations from capital bond proceeds and moneys from repayment of loans from appropriations from capital bond proceeds may be used only for the costs of projects authorized under subsection (2) (a), (i), and (j) of this section, and not for the administrative costs of the department.

          (4) All revenue generated from interest on security deposits in pooled interest-bearing trust accounts shall be used solely for the costs of projects in privately owned housing authorized under subsection (2)(b) of this section.

 

        Sec. 2.  RCW 59.18.270 and 1975 1st ex.s. c 233 s 1 are each amended to read as follows:

          (1) All moneys paid to ((the)) a landlord who owns ten or fewer units by ((the)) a tenant as a deposit as security for performance of the tenant's obligations in a lease or rental agreement shall promptly be deposited by the landlord in a trust account, maintained by the landlord for the purpose of holding such security deposits for tenants of the landlord, in a bank, savings and loan association, mutual savings bank, or licensed escrow agent located in Washington.  Unless otherwise agreed in writing, the landlord shall be entitled to receipt of interest paid on such trust account deposits.

          (2) With respect to all security deposits under leases or rental agreements entered into, renewed, or extended by landlords who own more than ten units, a landlord shall place all security deposits in a pooled interest-bearing trust account.  The landlord shall direct the depository institution to pay at least every six months the interest on this pooled interest-bearing trust account, minus reasonable transaction costs not to exceed one percent of a typical passbook rate, to the state treasurer to be placed in the housing trust fund established by RCW 43.185.030.

          (3) The landlord shall provide the tenant with a written receipt for the deposit and shall provide written notice of the name and address and location of the depository and any subsequent change thereof.  If during a tenancy the status of landlord is transferred to another, any sums in the deposit trust account affected by such transfer shall simultaneously be transferred to an equivalent trust account of the successor landlord, and the successor landlord shall promptly notify the tenant of the transfer and of the name, address and location of the new depository.  The tenant's claim to any moneys paid under this section shall be prior to that of any creditor of the landlord, including a trustee in bankruptcy or receiver, even if such moneys are commingled.

 

          NEW SECTION.  Sec. 3.  Section 2 of this act shall take effect January 1, 1994.
