Creating a process for maintenance and efficient operation of state agency and school district facilities.


          AN ACT Relating to the maintenance and efficient operation of state agency and school district facilities; and adding a new chapter to Title 43 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

          NEW SECTION.  Sec. 1.  (1) The legislature finds that the capital stock of facilities owned by state agencies and school districts represents a significant financial investment by the citizens of the state of Washington, and that providing for a responsible and efficient level of facility maintenance and operation is critical to preserving these facilities and realizing the full value of this investment.  The legislature also finds that ongoing reinvestment in facilities through adequate preventative maintenance funding can delay the need for capital expenditures for replacement facilities, reduce operating costs, and provide higher levels of service.  Further, while the state has established policies for acquisition, design, and construction of new facilities, no similar policies and standards have been established for maintenance and operation of facilities.

          (2) The purpose of this chapter is to develop state agency and school district facility management, operation, personnel, and budgeting policies and procedures that serve to adequately protect capital investments, reduce operating costs, and maximize the useful life of facilities.

 

          NEW SECTION.  Sec. 2.  For the purposes of this chapter, unless the context indicates otherwise, the following definitions apply:

          (1) "Condition assessment program" means a system for identifying, evaluating, prioritizing, documenting, reporting, and monitoring the specific maintenance requirements of facilities.

          (2) "Maintenance" means the upkeep of facilities and equipment, including periodic inspection, adjustment, lubrication, cleaning, replacement of parts and filters, painting, sealing, resurfacing, and other actions taken to ensure continuous service, prevent breakdown, and extend the useful life of a facility.

          (3) "Operation" means actions to control the usage of building systems including, but not limited to, lighting, heating, ventilation, and air conditioning systems.

          (4) "Reinvestment standard" means the amount of annual funding expressed as a percentage of facility replacement values necessary to ensure a level of facility maintenance consistent with the purpose of this chapter.

          (5) "School district" means each corporate body empowered under chapter 28A.320 RCW and responsible for managing school facilities within a designated territory.

          (6) "School facilities" means all buildings and related structures and facilities owned or being acquired by school districts.

          (7) "State agency" means all agencies, departments, boards, commissions, and institutions of the state of Washington, including institutions of higher education as defined in chapter 28B.10 RCW. 

          (8) "State facilities" means all buildings and related structures and facilities owned by state agencies or being acquired under chapter 39.94 RCW.

 

          NEW SECTION.  Sec. 3.  (1) The office of financial management shall develop facility management guidelines consistent with the purpose of this chapter for all state agencies.  The guidelines must include:

          (a) Recommended policies and procedures to ensure adequate maintenance and efficient operation of state facilities;

          (b) Standards and specifications for condition assessment programs to guide and assist agencies in successfully implementing the programs, and that allow for the uniform reporting of condition assessment information to the office of financial management; and

          (c) Procedures for establishing reinvestment standards for use by state agencies in developing prudent maintenance budgets consistent with the purpose of this chapter.

          (2) The office of financial management shall develop a centralized condition assessment and maintenance budgeting reporting system for state agencies.  The reporting system shall capture those data elements that are essential for policy and budget review and evaluation by the governor and the legislature, including, but not limited to, facility condition ratings and annual maintenance expenditures on a per-square-foot basis.

 

          NEW SECTION.  Sec. 4.  (1) The superintendent of public instruction shall develop facility management guidelines consistent with the purpose of this chapter for all school districts.  The guidelines must include:

          (a) Recommended policies and procedures to ensure adequate maintenance and efficient operation of school facilities;

          (b) Standards and specifications for condition assessment programs to guide and assist school districts in successfully implementing such programs, and that allow for the uniform reporting of condition assessment information to the superintendent of public instruction; and

          (c) Procedures for establishing reinvestment standards for use by school districts in developing prudent maintenance budgets consistent with the purpose of this chapter.

          (2) The superintendent of public instruction shall develop a centralized condition assessment and maintenance budgeting reporting system for school districts.  The reporting system must capture those data elements that are essential for policy and budget review and evaluation by the superintendent of public instruction, the governor, and the legislature, including, but not limited to, facility condition ratings and annual maintenance expenditures on a per-square-foot basis.

 

          NEW SECTION.  Sec. 5.  The office of financial management and superintendent of public instruction shall jointly establish an advisory committee to assist in the development of the guidelines, policies, procedures,  standards, and centralized reporting systems required under sections 3 and 4 of this act.  The advisory committee shall include representatives from state agencies, school districts, the legislative fiscal committees, the maintenance and crafts trades, and other agencies or groups as appropriate.

 

          NEW SECTION.  Sec. 6.  The state board for community and technical colleges shall develop a model training program in facility management, operation, and maintenance at one or more of the community and technical colleges.  The training program must provide comprehensive instruction on management, operation, and maintenance of building systems commonly found in state agency and school district facilities.

 

          NEW SECTION.  Sec. 7.  The department of personnel shall:

          (1) Identify all job classes that involve the management, operation, or maintenance of state facilities;

          (2) Determine whether existing minimum qualification requirements for the job classes ensure an adequate level of training and experience to perform the jobs consistent with the purpose of this chapter; and

          (3) Revise the minimum qualification requirements as needed to ensure that persons filling the positions demonstrate an adequate level of training and experience.

 

          NEW SECTION.  Sec. 8.  The higher education personnel board shall:

          (1) Identify all job classes that involve the management, operation, or maintenance of higher education facilities;

          (2) Determine whether existing minimum qualification requirements for the job classes ensure an adequate level of training and experience to perform the jobs consistent with the purpose of this chapter; and

          (3) Revise the minimum qualification requirements as needed to ensure that persons filling the positions demonstrate an adequate level of training and experience.

 

          NEW SECTION.  Sec. 9.  The office of financial management, the superintendent of public instruction, the state board for community and technical colleges, the department of personnel, and the higher education personnel board shall each report to the legislature on the implementation of this chapter by July 1, 1994.

 

          NEW SECTION.  Sec. 10.  This chapter may be known and cited as the public building asset protection act.

 

          NEW SECTION.  Sec. 11.  Sections 1 through 10 of this act shall constitute a new chapter in Title 43 RCW.
