Prohibiting locating correctional facilities near places with vulnerable individuals.



    AN ACT Relating to siting of adult detention facilities; adding a new section to chapter 72.65 RCW; and providing an effective date.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 72.65 RCW to read as follows:

    (1) The department may not establish or relocate an adult detention facility in a new location that is closer than two miles from a school, day care center, or a facility whose primary service clients are children, developmentally disabled adults, or other individuals deemed vulnerable by the director, such as the aged or infirm.

    (2) The department may not establish or relocate an adult detention facility in a new location until after the department holds a minimum of two public hearings.

    (3) The department of community, trade, and economic development shall establish procedures providing for early and continuous public participation in the development of adult detention facility placement plans.  The procedures must provide, with particular emphasis on the communities surrounding the proposed siting, for broad dissemination of proposals and alternatives, opportunity for written comments, public meetings after effective notice, provision for open discussion, communication programs, information services, and consideration of and response to public comments.

 

    NEW SECTION.  Sec. 2.  If any provision of this act or its application to any person or circumstance is held invalid, the remainder of the act or the application of the provision to other persons or circumstances is not affected.

 

    NEW SECTION.  Sec. 3.  This act shall take effect July 1, 1994.
