Authorizing state agencies to contract out for services.



    AN ACT Relating to privatization; and adding a new section to chapter 41.06 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 41.06 RCW to read as follows:

    An agency may purchase services customarily and historically provided by employees in classified service under this chapter by contracting with individuals or business entities, without the necessity of showing that classified employees could not provide these services if:

    (1) The agency director believes that the contracting out is fiscally prudent, with measurable justifications backing up the belief;

    (2) The affected agency has conducted a feasibility study to determine the cost-effectiveness of the action, and that this study has been reviewed by the director of financial management for accuracy, and that the cost-effectiveness means at a minimum a five percent reduction in costs to taxpayers; and

    (3) The contractor hired to perform the functions previously done by state employees pays employees wages that are similar to what state employees received for the same work within the same geographic region, and provides benefits that are similar to what state employees received.
