Requiring educational institutions to provide information to deter harassment and discrimination.



    AN ACT Relating to educational equity; adding a new section to chapter 28A.230 RCW; adding a new section to chapter 28A.195 RCW; adding a new section to chapter 28A.300 RCW; adding a new section to chapter 28B.10 RCW; adding a new section to chapter 28B.80 RCW; and creating a new section.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  The legislature finds that additional methods of disseminating information regarding educational equity are needed within educational institutions to deter harassment and discrimination based on race, creed, color, national origin, age, gender, marital status, or the presence of any sensory, mental, or physical handicap.  The legislature finds that many students and employees may become victims of discrimination unless appropriate avenues for distribution of information are established.  Legislation is therefore necessary to require additional information to prevent unlawful discrimination in educational institutions.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 28A.230 RCW to read as follows:

    (1) Each common school shall, within the resources available to it, prepare, publish, and distribute to all employees and students, its policies and procedures to prevent unlawful discrimination.

    (2) Each common school shall provide information requested by the superintendent of public instruction for the purposes of section 4 of this act.

 

    NEW SECTION.  Sec. 3.  A new section is added to chapter 28A.195 RCW to read as follows:

    (1) Each private school shall, within the resources available to it, prepare, publish, and distribute to all employees and students, its policies and procedures to prevent unlawful discrimination.

    (2) Each private school shall provide information requested by the superintendent of public instruction for the purposes of section 4 of this act.

 

    NEW SECTION.  Sec. 4.  A new section is added to chapter 28A.300 RCW to read as follows:

    The superintendent of public instruction shall report biennially, beginning December 31, 1995, to the governor and to the education committees of the house of representatives and the senate on the institutional efforts to comply with sections 2 and 3 of this act.  The reports shall include recommendations on measures to assist common schools and private schools with compliance.

 

    NEW SECTION.  Sec. 5.  A new section is added to chapter 28B.10 RCW to read as follows:

    (1) Each institution of higher education shall, within the resources available to it, prepare, publish, and distribute to all employees and students, its policies and procedures to prevent unlawful discrimination.

    (2) Each institution of higher education shall provide information requested by the higher education coordinating board for the purposes of section 6 of this act.

 

    NEW SECTION.  Sec. 6.  A new section is added to chapter 28B.80 RCW to read as follows:

    The higher education coordinating board shall report biennially, beginning December 31, 1995, to the governor and the higher education committees of the house of representatives and the senate on institutional efforts to comply with section 5 of this act.  The reports shall include recommendations on measures to assist institutions of higher education with compliance.
