Protecting unattended children in motor vehicles.



    AN ACT Relating to children in motor vehicles; amending RCW 46.61.685; and repealing RCW 9.91.060.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 46.61.685 and 1990 c 250 s 57 are each amended to read as follows:

    It is unlawful for any person, while operating or in charge of a vehicle, to park or willfully allow ((such)) the vehicle to stand upon a public highway or in a public place with its motor running, leaving a minor child or children under the age of sixteen years ((unattended)) in the vehicle unattended by a person sixteen years of age or older.  If a child is ten years of age or younger, it is unlawful to leave the child in a vehicle unattended by a person sixteen years of age or older whether or not the vehicle's motor is running.

    Any person violating the provisions of this section is guilty of a misdemeanor.  Upon a second or subsequent conviction for a violation of this section, the department shall revoke the operator's license of ((such)) the person.

 

    NEW SECTION.  Sec. 2.  RCW 9.91.060 and 1951 c 270 s 17 are each repealed.
