Concerning amateur radio communications.



    AN ACT Relating to regulation of amateur radio communication; adding a new section to chapter 35.21 RCW; and adding a new section to chapter 36.32 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 35.21 RCW to read as follows:

    Cities and towns, including code cities, are subject to the amateur radio preemption and other orders and rules adopted by the federal communications commission limiting their authority to restrict amateur radio antennas.  Any restrictions that a city or town, including a code city, adopts relating to the height or location of amateur radio antennas, or establishing screening requirements for amateur radio antennas, that are based on public health, safety, or aesthetic considerations, must be crafted to reasonably accommodate amateur radio communications and must represent the minimal practicable regulation necessary to accomplish the city's or town's legitimate purposes.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 36.32 RCW to read as follows:

    Counties are subject to the amateur radio preemption and other orders and rules adopted by the federal communications commission limiting their authority to restrict amateur radio antennas.  Any restrictions that a county adopts relating to the height or location of amateur radio antennas, or establishing screening requirements for amateur radio antennas, that are based on public health, safety, or aesthetic considerations, must be crafted to reasonably accommodate amateur radio communications and must represent the minimal practicable regulation necessary to accomplish the county's legitimate purposes.
