AN ACT Relating to incorporations of cities and towns; amending RCW 35.02.020; adding new sections to chapter 35.02 RCW; and prescribing penalties.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1. A new section is added to chapter 35.02 RCW to read as follows:

Any person proposing the incorporation of a city or town shall file a notice of the proposed incorporation with the auditor of the county in which all or the major portion of the proposed city or town is located. The notice shall include the matters required to be included in the petition under RCW 35.02.030 and be accompanied by both a one hundred dollar filing fee and an affidavit that the person is a registered voter residing in the proposed city or town.

Within ten working days of receiving such a complete notice, the auditor shall provide the person who filed the notice with written confirmation of an identification number for the petition and include both the date of the written confirmation and the last date that the petition proposing the incorporation may be filed.

Within ten working days of receiving this notice, the auditor shall provide notice of the proposed incorporation to each local newspaper of general circulation and each local radio and television station, that has filed a written request under RCW 42.30.080 to be notified of special meetings of the county legislative authority.

NEW SECTION. Sec. 2. A new section is added to chapter 35.02 RCW to read as follows:

A petition proposing the incorporation of a city or town shall be submitted substantially in the following form:

WARNING

Every person who signs this petition with any other than his or her true name, knowingly signs more than one of these petitions, signs this petition when he or she is not a legal voter, or makes any false statement on this petition may be punished by fine or imprisonment or both.

Sec. 3. RCW 35.02.020 and 1986 c 234 s 3 are each amended to read as follows:

A petition for incorporation must be signed by ((~~qualified~~)) registered voters resident within the limits of the proposed city or town equal in number to at least ten percent of the ((~~votes cast at the last state general election and presented to~~)) number of voters residing within the proposed city or town and filed with the auditor of the county in which all, or the largest portion of, the proposed city or town is located. The petition must be filed with the auditor within one hundred eighty days or fewer days after the written confirmation date that is provided under section 1 of this act.

NEW SECTION. Sec. 4. A new section is added to chapter 35.02 RCW to read as follows:

No city or town in a county which urban growth areas, or interim urban growth areas, have been designated under chapter 36.70A RCW may incorporate that includes territory located beyond an urban growth area or interim urban growth area.
