Modifying provisions for nursing assistant training, certification, and compensation.



    AN ACT Relating to nursing assistants; amending RCW 74.46.240; adding a new section to chapter 18.88A RCW; and adding a new section to chapter 18.51 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 18.88A RCW to read as follows:

    (1) A nursing assistant employed by a nursing home, who has satisfactorily completed an omnibus budget reconciliation act (OBRA) approved nursing assistant training program under this chapter, shall, upon application to the department of social and health services, be issued a certificate of completion within thirty calendar days of submitting the application.

    (2) Nursing assistants employed by a nursing home must show evidence of satisfactory completion of an omnibus budget reconciliation act (OBRA) approved nursing assistant training program, or that they are enrolled in and are progressing satisfactorily towards completion of an omnibus budget reconciliation act (OBRA) approved training program under standards adopted by the department of social and health services.  An omnibus budget reconciliation act (OBRA) approved training program must be satisfactorily completed within six months of initial employment.  A nursing home may employ a person not currently enrolled if the employer within twenty days enrolls the person in an omnibus budget reconciliation act (OBRA) approved training program, however a nursing home may not assign an assistant to provide resident care until the assistant has demonstrated skills necessary to perform assigned duties and responsibilities competently.

    (3) A nursing home employee enrolled in an omnibus budget reconciliation act (OBRA) approved training program provided by the facility that meets the requirements of subsection (2) of this section shall receive compensation at the same rate as that provided for in RCW 74.46.430.

 

    Sec. 2.  RCW 74.46.240 and 1980 c 177 s 24 are each amended to read as follows:

    (1) Necessary and ordinary expenses of on-the-job training and in-service training required for employee orientation and certification training directly related to the performance of duties assigned will be allowable costs.  No costs may be allowed for an omnibus budget reconciliation act (OBRA) approved nursing assistant training programs where the training program requires trainees to attend and complete training without receiving compensation as provided in RCW 74.46.430.

    (2) Necessary and ordinary expenses of recreational and social activity training conducted by the contractor for volunteers will be allowable costs.

 

    NEW SECTION.  Sec. 3.  A new section is added to chapter 18.51 RCW to read as follows:

    Compliance with section 1 of this act is a condition of licensure under this chapter.
