Allowing a single set of standards in rules for storm water discharge permits and for sediment quality control and sediment source control.



    AN ACT Relating to storm water discharges and sediment contamination; and adding a new section to chapter 90.48 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 90.48 RCW to read as follows:

    (1) If the department adopts rules for permits for storm water discharges under this chapter or under the federal clean water act it shall establish only one set of standards for control of storm water discharges.

    (2) If the department adopts rules establishing standards for sediment quality control and sediment source control, it shall establish only one set of standards for sediment source control and sediment quality control for permits for storm water discharges.  The standards shall allow the same time period for compliance with the standards for all discharges, whether publicly or privately owned or operated.

    (3) If the department adopts rules establishing sediment quality standards for marine or fresh waters, and by rule authorizes the establishment of a dilution zone, the department shall not authorize a permit holder to exceed the maximum sediment quality criteria within a dilution zone.

    (4) This section shall apply to rules adopted by the department before or after the effective date of this act.
