Establishing bail restrictions for persons charged with certain criminal offenses.



    AN ACT Relating to bail for persons charged with certain criminal offenses; adding a new section to chapter 10.19 RCW; adding a new section to chapter 10.82 RCW; and declaring an emergency.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 10.19 RCW to read as follows:

    (1) As used in this section:

    "Crime with bail restrictions" means a crime under any of the following:

 

    (a) Homicide.................. 9A.32.030, 9A.32.040, 9A.32.050

    (b) Manslaughter......................... 9A.32.060, 9A.32.070

    (c) Assault....... 9A.36.011, 9A.36.021, 9A.36.031, 9A.36.041,

    (2) A person charged with a crime with bail restrictions may post the required amount of bail in the form of:

    (a) Full cash;

    (b) A surety bond executed by a duly licensed bail surety; or

    (c) A bail bond secured by real property situated in this state, fully unencumbered and equal to the amount of bail undertaken plus five thousand dollars.

    (3) A court may designate the amount of bail without designating the form in which the bail may be posted.  When the court does not designate the form, bail may be posted in any combination of the forms authorized in subsection (2) of this section.

    (4) When bail is posted in the form of a bail bond secured by real property, the owner of the real property shall file:

    (a) An affidavit containing a legal description of the real property, and a statement that the affiant is the sole owner of the property and that the same is unencumbered.

    (b) A professional appraisal, acceptable to the court, of the current market value of the property.

    (5) Nothing in this section is intended to preclude a court from releasing a person on the person's own recognizance when the court, upon its own and for itself, determines that the person is deserving.

 

    NEW SECTION.  Sec. 2.  A new section is added to chapter 10.82 RCW to read as follows:

    When a person charged with a criminal offense posts bail, ten dollars of the total amount required to be posted as bail shall be paid in cash as a nonrefundable bail fee.  The bail fee shall be distributed by the county treasurer as follows:

    (1) One-third shall be forwarded to the department of labor and industries to be deposited into the victims' compensation fund established under RCW 7.68.090;

    (2) One-third shall be credited to the court for administrative costs; and

    (3) One-third shall be used for local law enforcement costs.

 

    NEW SECTION.  Sec. 3.  This act is necessary for the immediate preservation of the public peace, health, or safety, or support of the state government and its existing public institutions, and shall take effect immediately.
