Authorizing uses of bond proceeds in the local improvements revolving account‑-water supply facilities.



    AN ACT Relating to fisheries and water conservation; and amending RCW 43.99E.025.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 43.99E.025 and 1991 c 3 s 302 are each amended to read as follows:

    (1) The proceeds from the sale of the bonds deposited in the state and local improvements revolving account‑-water supply facilities of the general fund under the terms of this chapter shall be divided into two shares as follows:

    (((1))) (a) Seventy-five million dollars, or so much thereof as may be required, shall be used for domestic, municipal, and industrial water supply facilities; and

    (((2))) (b) Fifty million dollars, or so much thereof as may be required, shall be used for water supply facilities for agricultural use ((alone or in combination with)) and for fishery, recreational, or other beneficial uses of water in agricultural areas.

    (2) The share of seventy-five million dollars shall be administered by the department of health and the share of fifty million dollars shall be administered by the department of ecology, subject to legislative appropriation.  The administering departments may use or permit the use of any funds derived from the sale of bonds authorized under this chapter to accomplish the purpose for the issuance of the bonds by direct expenditures and by grants or loans to public bodies, including grants to public bodies as matching funds in any case where federal, local, or other funds are made available on a matching basis for improvements within the purposes of this chapter.

    (3) Proceeds under subsection (1)(b) of this section may be used for funding improvements by individual landowners if the improvements result in net water savings and if the savings are returned to the state as trust water under chapter 90.42 RCW.  Proceeds may also be used for direct purchase or lease of water rights by the state for management as trust water under chapter 90.42 RCW.  Where feasible, such water shall be used for instream flows.

    (4) In administering proceeds under subsection (1)(b) of this section, the department shall prioritize for funding those projects that result in water conservation or improved water use efficiency, or that benefit the fisheries resource.  Grants and loans issued to public bodies under this chapter for projects that result in water conservation shall only be issued if a significant portion of conserved water is returned to the state as trust water under chapter 90.42 RCW.  Where feasible, such trust water shall be used for instream flows.
