Granting immunity to nonprofit corporations donating medical equipment or supplies.

          AN ACT Relating to immunity for donating medical equipment and supplies; and adding a new section to chapter 4.24 RCW.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

NEW SECTION. Sec. 1.  A new section is added to chapter 4.24 RCW to read as follows:

          (1) A nonprofit corporation that, in good faith and without compensation, donates medical equipment or supplies to any person or organization is not liable for civil damages arising from any injury or death resulting from the use of the equipment or supplies, unless the donation constitutes gross negligence or willful misconduct.

          (2) A member of the board of directors, or an officer or employee of any nonprofit corporation is not individually liable for civil damages arising from any injury or death resulting from the use of medical equipment or supplies that were donated by the corporation in good faith and without compensation to any person or organization, unless the donation constitutes gross negligence or willful misconduct.
