Changing obstructing a public servant to obstructing a law enforcement officer.



    AN ACT Relating to obstructing a law enforcement officer; amending RCW 9A.76.020; and prescribing penalties.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    Sec. 1.  RCW 9A.76.020 and 1975 1st ex.s. c 260 s 9A.76.020 are each amended to read as follows:

    ((Every person who, (1) without lawful excuse shall refuse or knowingly fail)) It is unlawful for any person to make any willfully untrue, misleading, or ((furnish any)) exaggerated statement to a law enforcement officer, ((report,)) or ((information lawfully required of him by a public servant, or (2) in any such statement or report shall make any knowingly untrue statement to a public servant, or (3) shall knowingly)) to willfully hinder, delay, or obstruct any ((public servant)) law enforcement officer in the discharge of his or her official powers or duties((; shall be guilty of)).  For the purposes of this section, "law enforcement officer" shall include, in addition to officers of the Washington state patrol and police and sheriff departments, other public officers who are responsible for enforcement of criminal laws, fire codes, building codes, zoning codes, and life and safety codes.  Violation of this section is a misdemeanor.
