Prohibiting bonded indebtedness for capital projects that are not owned by a public entity.



    AN ACT Relating to capital appropriations; and adding a new section to chapter 43.88 RCW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON:

 

    NEW SECTION.  Sec. 1.  A new section is added to chapter 43.88 RCW to read as follows:

    (1) The state finance committee shall not issue bonded indebtedness for any capital project that involves the acquisition or improvement of real property, or related planning and design work, unless the property being improved or acquired will be owned by a public entity.  "Public entity," as used in this section, is limited to the federal government, agencies of the state, and political subdivisions of the state.

    (2) This section does not apply to capital appropriations for:

    (a) Performing arts, museum, and cultural organizations under the competitive grants program administered by the department of community, trade, and economic development under section 230, chapter 22, Laws of 1993 sp. sess. and subsequent appropriations, if the appropriations under this subsection (2)(a) do not exceed one percent of the total biennial capital appropriations;

    (b) Housing assistance programs administered under chapter 43.185, 43.185A, or 70.164 RCW; or

    (c) Wildlife habitat improvements.

    (3) This section does not apply to capital appropriations or reappropriations made before January 1, 1994.
