     On page 78, after line 33, insert the following:

     "NEW SECTION.  Sec. 308.  A new section is added to 1995 2nd sp. s. c 18 (uncodified) to read as follows:

FOR THE OFFICE OF MARINE SAFETY

Oil Spill Administration Account Appropriation ....$  2,467,000

State Toxics Control Account Appropriation.........$    172,000

              TOTAL APPROPRIATION ................$  2,639,000

     The appropriation in this section is subject to the following conditions and limitations:

     (1) $385,000 of the oil spill administration account appropriation is provided solely for the defense of the Intertanko litigation (Intertanko v. Washington, cause number C951096C). 

     (2) $2,082,000 of the oil spill administration account appropriation and $172,000 of the state toxics control account appropriation are provided solely for general operating expenses of the agency beginning April 1, 1996.  On April 1, 1996, the office of marine safety shall cease receiving quarterly reimbursements from the department of ecology for general operating expenses.  To the extent that expenditures are made from the amounts provided in this subsection, an equal amount from the appropriation in section 412, chapter 14, Laws of 1995 2nd sp. sess. shall lapse."


 

 

 

EFFECT:  Provides funding for the Office of Marine Safety as a separate state agency beginning April 1, 1996.  Provides an additional $385,000 to the Office for legal expenses related to a lawsuit filed by the International Association of Independent Tanker Owners (Intertanko).  

     FISCAL IMPACT: 

Shifts $2,254,000 in other funds from the Transportation budget to the Omnibus Operating Budget.  Increases other funds by $385,000.
