     On page 12, line 3 of the amendment, after "connection," strike everything down to and including "system" on line 11 and insert "except that a penalty may not exceed one thousand dollars per service connection if the public water system has less than one thousand connections and the person had submitted all information and plans to the department necessary for departmental approval for modification or expansion of the system and the department has not acted within a reasonable period of time. ((or, in)) In the case of a system serving a transient population, a penalty of not more than four hundred dollars per person based on the highest average daily population the system serves or is anticipated to serve may be imposed.  The total penalty that may be imposed pursuant to this subsection (1)(b) is five hundred thousand dollars"

EFFECT:  Corrects a penalty provision pertaining to small water systems that expand or modify a system without department approval.
