                Law & Justice, January 26, 1995

Title:  An act relating to judgments.

Brief Description:  Regarding the renewal of judgments and the extension of judgment liens.

Sponsors:  Senator Smith.

Brief History:

Committee Activity:  Law & Justice:  1/23/95, 1/26/95 [DPS].

SENATE COMMITTEE ON LAW & JUSTICE

Majority Report:  That Substitute Senate Bill No. 5166 be substituted therefor, and the substitute bill do pass.

Signed by Senators Smith, Chair; C. Anderson, Vice Chair; Hargrove, Haugen, Johnson, Long, McCaslin, Quigley, Rinehart, Roach and Schow.

Staff:  Martin Lovinger (786-7443)

Background:  In 1994, the Legislature enacted a law that permits civil judgments to be renewed and enforced for an additional ten-year period.  However, no language was included to extend a judgment lien based on an underlying judgment that has been renewed under this statute.

Summary of Substitute Bill:   A lien based upon an underlying judgment that has been renewed continues in force for an additional ten-year period.

Substitute Bill Compared to Original Bill:  The substitute bill clarifies that the lien being renewed is based upon an underlying judgment and not against the judgment itself.

Appropriation:  None.

Fiscal Note:  Not requested.

Effective Date:  Ninety days after adjournment of session in which bill is passed.

Testimony For:  This is a technical correction to address an oversight in the law enacted last year to allow renewal of judgments.

Testimony Against:  None.

Testified:  Kathy Rouner, Allied Credit (pro); Mark Gjurasic, Washington Collectors Association (pro).
