Background:  The Department of Labor and Industries and self-insurers may make provisional payments to industrial insurance claimants pending ultimate disposition of a claim.  If a claim is denied, or the provisional payments exceed the amount amended, the recipient must repay and recovery may be made against any future payments.

 

Summary of Substitute Bill:  The repayment or recoupment of provisional industrial insurance payments is limited to three month=s overpayment.
