SB 5916 - DIGEST

 

     Declares that no person may engage in trafficking of any product, item, or a substance intended for human consumption containing or purporting to contain any substance derived from any species listed in 50 C.F.R. Sec. 23.23 as that section existed on the effective date of this act.

     Provides that a person who knowingly violates this act is guilty of a gross misdemeanor.

     Provides that any person who knowingly violates this act may be assessed a civil penalty by the director of not more than twenty-five thousand dollars for each violation.

     Declares that any product, item, or substance sold or attempted to be sold, contrary to the provisions of this act shall be subject to forfeiture to the state.  All equipment, vessels, vehicles, aircraft, and other means of transportation used to aid the selling, or an attempt to sell any product, item, or substance in violation of this act shall be subject to forfeiture to the state upon conviction of a criminal violation under this act.
