    On page 28, after line 28, insert the following:

 

                    "PART VI - TOLL FACILITIES

 

    Sec. 601.  RCW 47.56.075 and 1984 c 7 s 252 are each amended to read as follows:

    (1) The department shall approve for construction only such toll roads as the legislature specifically authorizes or such toll facilities as are specifically sponsored by a city, town, or county.

    (2) Notwithstanding subsection (1) of this section, the commission shall impose tolls on completed improvement projects costing in excess of one hundred million dollars and for which bonds are issued by the state to fully or partially finance the projects, in an amount to be determined by the commission under RCW 47.56.030.

    (3) The commission shall retain toll charges on the facilities provided for in subsection (2) of this section until:

    (a) All costs of investigation, financing, acquisition of property, and construction advanced from the motor vehicle fund have been fully repaid;

    (b) Obligations incurred in constructing that facility have been fully paid; and

    (c) The motor vehicle fund is fully repaid for any amounts advanced for construction.

    (4) Upon meeting the obligations provided for in subsection (3)(a), (b), and (c) of this section, the commission shall remove the tolls from the facility.

    (5) The department, the commission, and local governments are encouraged to enter into agreements to facilitate cooperation and coordination between the jurisdictions impacted by the projects provided for in subsection (2) of this section."

 

    Renumber the part and sections following consecutively, correct any internal references accordingly, and correct the title.

 

 

 


    EFFECT:  For those improvement projects that cost in excess of $100 million and for which bonds are issued to finance those projects, tolls must be placed on the completed facilities to pay off the bonds.  Once the bonds and all other obligations are paid off and the motor vehicle fund is fully repaid, the tolls must be removed.  The Department of Transportation, the Transportation Commission, and local governments are encouraged to enter into agreements to facilitate cooperation and coordination among the jurisdictions impacted by these types of improvement projects.
