Background:


Certain rules apply to the naming of subcontractors in bids for public works projects over $1 million. The rules apply to projects built by the state, an institution of higher education, or a municipality, for the subcontracted electrical, plumbing, or heating, ventilation, and air conditioning (HVAC) work on those public works projects.


Every invitation to bid must require each prime contract bidder to submit, as part of the bid, the names of the subcontractors with whom the bidder, if awarded the contract, will subcontract for the electrical, plumbing, or HVAC work, or name itself for the work.


Summary of Bill:


Bids shall not be publicly opened or read until the prime contract bidder submits the names of the subcontractors with whom he or she, if awarded the contract, will subcontract for the electrical, plumbing, or HVAC work. The names of the subcontractors shall be publicly read at the bid opening when bids are opened.

Effective Date: The bill takes effect 90 days after adjournment of session in which bill is passed.
