   On page 2, beginning on line 1, strike all of subsection (b) and insert the following:

 

   "(b) As specified in this subsection, majority rule applies when only one organization is seeking certification as the exclusive representative of an unrepresented bargaining unit or a petition seeking decertification of an organization as the exclusive representative of a bargaining unit is filed. If the showing of interest submitted in support of the petition indicates that a majority of the employees support the petition, the executive director of the public employment relations commission shall (i) conduct a cross-check comparing signature cards against the employer's employment records, and (ii) if majority support for the petition exists, either certify or decertify the organization as the exclusive representative."

 

 

   On page 3, beginning on line 23, strike all of subsection (a) and insert the following:

   "(a) ((If only one employee organization is seeking certification as exclusive bargaining representative of a bargaining unit for which there is no incumbent exclusive bargaining representative, the commission may, upon the concurrence of the employer and the employee organization, determine the question concerning representation by conducting a cross-check comparing the employee organization's membership records or bargaining authorization cards against the employment records of the employer)) (b) As specified in this subsection, majority rule applies when only one organization is seeking certification as the exclusive representative of an unrepresented bargaining unit or a petition seeking decertification of an organization as the exclusive representative of a bargaining unit is filed. If the showing of interest submitted in support of the petition indicates that a majority of the employees support the petition, the executive director of the public employment relations commission shall (i) conduct a cross-check comparing signature cards against the employer's employment records, and (ii) if majority support for the petition exists, either certify or decertify the organization as the exclusive representative; or"

EFFECT: Makes majority rule applicable when one organization seeks certification as the exclusive bargaining representative or a petition seeking decertification of an exclusive bargaining representative is filed.
