   On page 7, line 20, after "(4)" insert the following:

 

   "(a) An individual who is not entitled to be restored to a position of employment under subsection (1) of this section and who leaves work to obtain benefits under this chapter shall be disqualified from benefits under Title 50 RCW beginning with the first day of the calendar week in which he or she has left work and thereafter for seven calendar weeks and until he or she has obtained bona fide work in employment covered by Title 50 RCW and earned wages in that employment equal to seven times his or her weekly benefit amount. 

   (b) An individual is not disqualified from benefits under (a) of this subsection when: (i) The employer has made a promise to restore the individual to employment after a period of family leave; or (ii) the newborn or newly-adopted child has an illness or disability that requires the individual to leave work to care for the child as provided in RCW 50.20.050(2)(b)(ii).

   (5)"

 

   Renumber the remaining subsections consecutively and correct any internal references accordingly.

 

   On page 7, line 33, after "(6)" strike "This" and insert "Except for subsection (4) of this section, this"

 

 

EFFECT: Disqualifies from unemployment insurance benefits an individual who leaves work to obtain family leave insurance benefits and is not entitled to be restored to a position of employment. Does not disqualify an individual when his or her employer has promised to restore the individual to employment or his or her child has an illness or disability.
