   On page 24, after line 3, insert the following:

   "NEW SECTION.  Sec. 405.   A new section is added to chapter 72.09 RCW to read as follows:
   (1) Beginning January 1, 2008, the department shall submit an annual report to the governor and the legislature containing:

   (a) The number and custody levels of offenders supervised by the department during the previous calendar year;

   (b) The number and custody levels of offenders who violated one or more conditions of their community custody during the previous calendar year, other than new offenses, and the sanction or sanctions imposed for each violation;

   (c) The number and custody levels of offenders who violated one or more conditions of their community custody by committing new offenses while the offenders were on community custody during the previous calendar year, and the sentence imposed for each violation.

   (2) The department shall perform a study to determine the department's current and projected need for more bed space and the department's ability to adequately supervise the current and projected number of offenders serving a term of community custody. The department shall report the results of this study along with a plan to increase the number of beds, as appropriate, and to efficiently and effectively improve its supervision ability to the governor and the legislature by January 1, 2008. For purposes of this subsection, "adequately supervise" means to supervise in a manner that reduces recidivism by minimizing the number of community custody violations and new crimes committed by offenders under supervision."

 

   Renumber the sections consecutively, correct the internal references accordingly, and correct the title.

 

 

EFFECT: Requires DOC to provide an annual report to the Governor and the Legislature regarding offenders on community custody. The report must include the number of offenders on supervision, the number of violations that occurred, and the number and custody levels of offenders who were convicted of new crimes. The DOC must also conduct a study on the need for additional bed space and whether the DOC has the ability to adequately supervise all offenders on community custody.
