   On page 10, beginning on line 30 of the amendment, strike all of subsection (13) and insert the following:

 

   "(13)(a) A generation facility project under consideration by the energy facility site evaluation council before the adoption of rules in subsection (11) of this section shall submit a carbon sequestration plan that addresses the requirements of subsection (11) and the requirements under chapter 80.70 RCW as part of the energy facility site evaluation council process.

   (b) The carbon sequestration plan shall require the generation facility, at the end of each calendar year following the date of commercial operation, to pay an additional mitigation amount for each ton of carbon dioxide emitted in excess of the greenhouse gases emission performance standard during the calendar year. The mitigation amount shall be calculated using the per ton mitigation rate established under RCW 80.70.020(5) at the date of site certification approval.  

   (c) The department shall receive and administer the disbursement of the mitigation funds from the generation facility under subsection (b) of this section. In disbursing the mitigation funds, the department shall consider programs that support the research, development or commercial demonstration of geological sequestration technology, or rule-making efforts that support implementation of sequestration projects.

   (d) The carbon sequestration plan shall provide that at the time the generation facility begins carbon sequestration, the generation facility may sell carbon credits for all carbon dioxide sequestered by the facility into any cap and trade market.

   (e) The energy facility site evaluation council shall contract with the department to review and comment on the carbon sequestration plan within 90 days of receipt of the plan by the energy facility site evaluation council.

   (f) The carbon sequestration plan shall be considered as part of the site certification process of the generation facility. Upon approval by the energy facility site evaluation council, the carbon sequestration plan shall provide for the compliance of the generation facility under this section."

 

 

   EFFECT: Requires a generation facility project under   consideration by the Energy Facility Site Evaluation Council,    and before greenhouse gases emissions performance standard    rules are adopted by the Department of Ecology, to submit a    carbon sequestration plan that addresses the criteria applied    in evaluating carbon sequestration plans and the requirements    under chapter 80.70 RCW, the Carbon Dioxide Mitigation Program.

         Requires the generation facility to pay annually an    additional mitigation amount for each ton of carbon dioxide    emitted in excess of the greenhouse gases emission performance    standard during the calendar year. Specifies that the  mitigation amount is calculated using the per ton mitigation    rate under RCW 80.70.020(5) at the date of site certification    approval.

         Specifies that the Department of Ecology receives and    administers the additional mitigation payment. Requires the    Department of Ecology, in disbursing the funds generated by    the additional mitigation payment, to consider programs that    support the research, development or commercial demonstration    of geological sequestration technology, or rule-making efforts    that support implementation of sequestration projects.

         Authorizes the generation facility to sell carbon credits    for all carbon dioxide sequestered by the facility into any cap    and trade market.

         Requires the Energy Facility Site Evaluation Council to    contract with the Department of Ecology to review and comment    on the carbon sequestration plan as part of the Energy Facility    Site Evaluation Council Process.

         Provides that the carbon sequestration plan shall be    considered as part of the site certification process of the    generation facility. Provides that upon approval by the Energy    Facility Site Evaluation Council of the carbon sequestration    plan, the generation facility is in compliance with the    greenhouse gases emissions performance standard.
