   On page 6, after line 26 of the striking amendment, insert the following:

   "NEW SECTION. Sec. 6. A new section is added to chapter 36.70A RCW to read as follows:

   (1) Upon the filing of a timely and sufficient petition with the county or city legislative body, signed by registered voters equaling at least twenty percent of the votes cast in the county or city in the last general state election, the county or city shall be exempt from requirements to mitigate or otherwise address climate change under this chapter.

   (2)(a) Prior to filing, the petition sponsors shall notify the county auditor of their intention to file the petition. Upon notifying the auditor, the sponsors shall have one year to file the petition with the applicable legislative body. Upon receiving the sponsor's notice, the auditor shall, within thirty days, notify the following of the sponsor's intention to file the petition:

   (i) The county or city legislative body with whom the petition will be filed;

   (ii) The department; and

   (iii) The governor.

   (b) Failure of the auditor to perform notifications required by this subsection will not invalidate an otherwise valid petition.

   (3) Determinations of sufficiency for petitions filed under this section shall be made in accordance with RCW 35.21.005.

   (4) The effective date of an exemption under this section for a timely petition determined to be sufficient shall be the date of filing."

 

   Renumber the remaining sections consecutively and correct any internal references accordingly.

 

 

 

 

EFFECT: Establishes a petition-based exemption mechanism whereby registered voters equaling at least 20 percent of the votes cast in the county or city in the last general state election may exempt the jurisdiction from requirements to mitigate or otherwise address climate change under the Growth Management Act.
