   On page 6, after line 26 of the striking amendment, insert the following:

   "NEW SECTION. Sec. 6. Any entity or facility operating in accordance with regulations or standards established by the federal government cannot be required to reduce emissions below those standards nor in any way be penalized for activities that are lawful under such federal regulations or standards."

   Renumber the remaining sections consecutively and correct internal references accordingly.

EFFECT: 1) Prohibits a county or city from imposing emissions standards that are more stringent than those required under federal regulations or standards; and 2) prohibits a city or county from penalizing any entity for activities resulting in emissions that are lawful under applicable federal regulations or standards.
