Background: In 2007 the Legislature passed SSB 5533 (C 375 L 07) which repealed RCW 10.77.090, relating to competency restoration and civil commitment following dismissal of a criminal case, and replaced it with three new code sections. Several other statutes that point to the former RCW 10.77.090 now contain incorrect cross-references. SSB 5533 also changed the eligibility criteria for competency restoration treatment in nonfelony cases, rendering certain definitions and other sections in chapter 10.77 RCW obsolete.
