Brief Description: Changing the notification date for nonrenewal of a certificated employee's contract.

Brief Summary of Bill

  • Extends the deadline for notices of nonrenewal and transfer from June 1 to June 15 when the Legislature has not passed the Omnibus Appropriations Act by May 15.

Background:

Written notices of nonrenewal must be served upon certificated employees on or before May 15 preceding the commencement of the next term. If the Legislature has not passed the Omnibus Appropriations Act by May 15, then such notice must be served no later than June 1. These deadlines are applicable to nonrenewals of both provisional employees and employees under continuing contracts, and apply whether these persons are employed by a school district or an educational service district. If notice of nonrenewal is not timely served on an employee under a continuing contract, the employee is conclusively presumed to have been reemployed for the next ensuing term upon contractual terms identical with those which would have prevailed if the employee's contract had actually been renewed.

The same deadlines also apply with respect to the service of notice for transfer of an administrator.

Summary of Bill:

The June 1 deadline is changed to June 15. It is applicable only when the Legislature has not passed the Omnibus Appropriations Act by May 15.

Effective Date: The bill contains an emergency clause and takes effect immediately.
